The Ontario Government has introduced new legislation that will amend the Employment Standards Act, 2000 (ESA) with significant implications for persons with disabilities and their families.
Among the most important changes in Bill 148, the Fair Workplaces, Better Jobs Act, is the provision that will make mischaracterizing workers as independent contractors an offence under the ESA. While mischaracterizing workers has always been a risk for families, the proposed legislation signals a significant change in focus for the Ministry of Labour and will come with a heightened risk of complaints, investigations, fines and penalties.
Bill 148 also includes new changes that will impact the way that families work with temporary help agencies and employees, including new rules around paid time off, shift cancellation and on-call pay.
