[UPDATE: The Ina Road Interchange where the Denny's Restaurant is located is undergoing MASSIVE RE-CONSTRUCTION so I suggest you take the Cortaro Road Exit just north of the Ina interchange over to Silverbell Road, then south to Ina and then left back up to the Denny's. Warning, there will be massive barricades and construction occurring but we are having it here to make a point so you get first hand knowledge of the changes taking place on I-10 and it will be a challenge for you to make it to the Denny's where we are having our Meet Up and will probably have the whole place to ourselves! "The typical land contract is written to protect the seller. Usually the buyer (Vendee) makes a small down payment and therefore is in a relatively weak bargaining position. The contract dictates the type of deed to be delivered and the time of delivery. I strongly urge that the deed is held by the Account Servicing Department. One of the Handouts at the August Seminar will be a List of Clauses to be sure that are included in your Land Contract. I urge you to select an attorney who specializes in real estate to prepare the documents needed for Land Contract Transactions and "Wrap" Transactions.
Understand that you may use Deed of Trust, AITD (All-Inclusive Trust Deed) or Land contracts for Seller Financing. I will discuss the Pros and Cons of each at the upcoming Seminar. Recall that any of these methods will qualify for Installment Sales for Federal Income Tax Purposes.
I will give the attendees some examples of how I have set up these types of transactions and why I do each step. Suggestion: Take lots of notes!"
