Presentation Abstract: Large scale data breaches often lead to law suits. In order to proceed with a law suit, a plaintiffparty must show that it has sufficient connection to, and harm from the data breach, to support itsparticipation in the suit. In legal terms, this is called "standing". Over the years, courts have decideddifferently on the issue of standing. For example, some courts have held that a loss of a credit card andreimbursed fraudulent charges is not an injury to warrant standing. Other courts however, have concluded thata mere risk of identity theft is sufficient to warrant standing. This presentation will look at the recentdecisions and provide companies with insight and guidance on law suits stemming from data breaches, and how toprepare for potential litigation.
